In re Adoption of B.N., 2018 UT App 224 (Dec. 6, 2018)
At issue, in this case, was whether the Utah Code section governing the district in which adoption proceedings should commence limits the district court’s subject matter jurisdiction or is merely a venue statute. The court held that the statute spoke only to venue, and any district court has subject matter jurisdiction for an adoption. If the petition was filed in the wrong district, the district court must transfer the case to the correct district upon filing of a proper request.
